Welcome to Cutler Bay Flower Shop! These terms help ensure a smooth, joyful experience when you order our fresh floral arrangements for special moments like weddings or holidays. We offer same-day delivery in Miami-Dade and Broward, and by using our site or services, you agree to these simple rules. If you're under 18, please have a parent review them with you.

Acceptance of Terms


These Terms & Conditions form a binding agreement between you and Cutler Bay Flower Shop (doing business as Flowers by Karene, located at 22430 Old Dixie Hwy, Cutler Bay, FL 33170). We may update them—check back occasionally. Continued use means you accept changes.


Description of Services


We provide custom flower arrangements, including roses, orchids, and sunflowers, with local delivery or pickup. All sales are final once delivered, subject to our Returns Policy (linked below). We reserve the right to refuse or cancel orders for any reason, like unavailable items.


User Accounts


If you create an account, keep your login info safe—you're responsible for all activity. We'll notify you of unusual activity and may suspend accounts for violations.


Orders and Payments


  • Place orders via our site; we confirm via email.
  • Prices in USD include tax; delivery fees apply.
  • Payments via secure methods (credit cards, PayPal)—full payment due at checkout.
  • Taxes and fees: We collect applicable sales tax; you're responsible for any others.


Delivery and Shipping


Please refer to our Delivery Policy for full details. While we strive to ensure timely delivery, delays caused by weather conditions, inaccurate addresses, or circumstances beyond our control may occur. To maintain the highest level of freshness and quality, substitutions may be made when necessary. Any substitutions will always reflect the original style, value, and overall design of your arrangement.


Returns, Refunds, and Cancellations


Per our Returns Policy: No returns on fresh items post-delivery. Cancel within 24 hours for full refund; same-day cancellations aren't refundable. Replacements for damaged orders same-day only.


Intellectual Property


Our site photos, designs, and content are ours—use for personal reference only, no copying or commercial use without permission.


Limitation of Liability


To the fullest extent allowed by law, we're not liable for indirect damages (like lost profits) or issues beyond our control (force majeure: storms, strikes). Our total liability won't exceed your order value. Flowers are perishable—enjoy them as nature intended!


Governing Law and Disputes


All matters related to your order are governed by the laws of the State of Florida. In the event of a dispute, we will first make every effort to resolve the issue through good-faith communication. If the matter cannot be resolved informally, it will be handled in Small Claims Court in Miami-Dade County.


If arbitration becomes necessary, it will be binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA).


Indemnity


You agree to cover us for claims from your misuse of our services.


Force Majeure


We aren't responsible for delays from events like hurricanes or supply shortages.


Entire Agreement


These terms, plus our Policies, are the full deal—no side promises count.
